General Terms and Conditions
1. Scope
These General Terms and Conditions apply to all orders placed through the online shop of Mottis Dogwear, operated by Leonie Hübel, Fasanenweg 4, 91590 Bruckberg, Germany.
By placing an order through our online shop, the customer agrees to these General Terms and Conditions.
Our online shop is primarily intended for consumers. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or professional activity.
2. Contractual Partner
The purchase contract is concluded with:
Mottis Dogwear
Owner: Leonie Hübel
Fasanenweg 4

Germany

Phone: +49 151 74228380
3. Products and Product Presentation
Mottis Dogwear designs and produces handmade dog collars and dog leashes in small batches and on a made-to-order basis.
We make every effort to present our products, colours, patterns, materials and photographs as accurately as possible. Due to different screen settings, lighting conditions and the handmade nature of our products, slight variations in colour, pattern placement, stitching or appearance may occur.
Such minor variations that do not affect the functionality or agreed characteristics of the product do not constitute a defect.
The specific product description, dimensions, materials, available variants and other characteristics are stated on the respective product page.
4. Ordering and Conclusion of Contract
The presentation of products in our online shop does not constitute a legally binding offer but an invitation to place an order.
By clicking the final order button, the customer submits a binding offer to purchase the selected products.
Before submitting the order, the customer can review and correct their order details using the functions provided by the online shop.
The contract is concluded when Mottis Dogwear accepts the customer’s order. This acceptance normally takes place by sending an order confirmation by email.
The customer should therefore ensure that the email address provided during the ordering process is correct and accessible.
The customer will receive the relevant order and contract information electronically.
5. Made-to-Order Products
Mottis Dogwear products are handmade to order. Production generally begins after an order has been placed.
Because our products are handmade, production and delivery may take approximately two weeks, unless a different delivery period is stated on the respective product page or otherwise agreed with the customer.
Made-to-order production does not, by itself, exclude the statutory right of withdrawal.
Where a product is individually made according to the customer’s specific selection or is clearly tailored to the customer’s personal requirements, the statutory exception to the right of withdrawal under § 312g (2) No. 1 German Civil Code (BGB) may apply.
Further information is provided in our separate Right of Withdrawal information.
6. Cancellation
Customers may request cancellation of their order within 24 hours of placing the order by contacting us at contact@mottisdogwear.com.
The cancellation request must include the order number and clearly state that the customer wishes to cancel the order.
After the 24-hour cancellation period, production may already have started. Cancellation is then only possible where required by applicable statutory law or where Mottis Dogwear voluntarily agrees to the cancellation.
The statutory right of withdrawal, where applicable, remains unaffected.
7. Prices and Payment
All prices shown in the online shop are total prices and include any applicable statutory taxes.
Mottis Dogwear currently applies the German small business regulation pursuant to § 19 UStG. Therefore, VAT is not separately shown on invoices.
Available payment methods are displayed during the checkout process and may include payment services such as Shopify Payments, PayPal, Klarna, Apple Pay, Google Pay and American Express, depending on availability and customer eligibility.
Payment must be completed using one of the payment methods offered during checkout.
8. Delivery and Shipping
Mottis Dogwear currently ships orders within Germany using shipping providers such as DHL and Hermes. International orders may be shipped using UPS or another suitable shipping provider.
Available delivery countries, shipping costs and estimated delivery times are displayed during checkout or on the relevant shipping information page.
Because our products are handmade to order, the usual production and delivery time is approximately two weeks unless otherwise stated on the respective product page.
Delivery times may be affected by circumstances outside our reasonable control, including delays caused by shipping providers, customs authorities or other external circumstances.
For international orders, the customer is responsible for complying with applicable import requirements and, where applicable, paying customs duties, import taxes or other charges imposed by the destination country.
9. Transfer of Risk
For consumers, the statutory rules regarding the transfer of risk apply.
Mottis Dogwear therefore does not transfer the risk of accidental loss or accidental damage to the customer before the goods have been delivered to the customer or a person designated by the customer, unless otherwise provided by mandatory law.
10. Right of Withdrawal
Where a statutory right of withdrawal applies, consumers have the statutory right to withdraw from the contract within the applicable withdrawal period.
The withdrawal period is generally 14 days, subject to the statutory requirements and exceptions.
Certain individually made or personalised products may be excluded from the statutory right of withdrawal under § 312g (2) No. 1 BGB.
The complete withdrawal information, including the conditions, procedure and model withdrawal form, is provided separately on our website.
Nothing in these Terms and Conditions limits any mandatory statutory consumer rights.
11. Returns and Exchanges
Where a statutory right of withdrawal applies, returns are handled in accordance with the applicable statutory withdrawal provisions.
Where the statutory withdrawal exception for individually made or personalised goods applies, the customer does not have a statutory right to return or exchange the product merely because they have changed their mind.
Voluntary exchanges or returns are not offered unless expressly agreed by Mottis Dogwear.
This does not affect the customer’s statutory rights in the event of defective, damaged or non-conforming goods.
12. Defects and Statutory Consumer Rights
The statutory consumer rights relating to defective or non-conforming goods apply.
If a product has a defect, the customer should contact us at contact@mottisdogwear.com and provide the order number and, where possible, photographs or other information describing the issue.
Depending on the circumstances and applicable law, the customer may have statutory rights including repair, replacement, reduction of the purchase price or withdrawal from the contract.
Mottis Dogwear does not provide a voluntary lifetime guarantee or warranty unless expressly stated otherwise for a particular product.
Any statutory rights remain unaffected by this provision.
13. Intended Use and Product Safety
Mottis Dogwear collars and leashes are intended for use with dogs and must only be used for their intended purpose.
Customers must regularly inspect the product before use and discontinue use if the product shows signs of damage, excessive wear, loose stitching, damaged hardware or any other condition that may affect safe use.
Mottis Dogwear products are not toys and must not be given to dogs for chewing.
Dogs can exert considerable and unpredictable forces. No collar or leash can be guaranteed to be completely failure-proof or indestructible.
Product-specific safety information and care instructions are provided on the respective product page or through our product safety information.
14. Liability
Mottis Dogwear is liable without limitation for damages arising from injury to life, body or health caused by an intentional or negligent breach of duty by Mottis Dogwear, its legal representatives or vicarious agents.
For other damages, Mottis Dogwear is liable in accordance with the applicable statutory provisions where the damage was caused intentionally or by gross negligence.
Any mandatory statutory liability, including liability under applicable product liability law, remains unaffected.
Nothing in these Terms and Conditions shall exclude or limit liability where such exclusion or limitation is prohibited by law.
15. Copyright and Intellectual Property
All illustrations, designs, photographs, graphics, texts, logos and other content created for or used by Mottis Dogwear are protected by applicable intellectual property laws.
Unless expressly permitted by Mottis Dogwear or by law, the content of the online shop may not be reproduced, distributed, modified, published or commercially used without prior permission.
The designs used on Mottis Dogwear products may be created in cooperation with independent artists. The respective usage rights are obtained by Mottis Dogwear for the purposes agreed with the respective artist.
16. Data Protection
Personal data is processed in accordance with our separate Privacy Policy.
The Privacy Policy explains which personal data is processed when using our online shop, for which purposes and on which legal basis.
17. Alternative Dispute Resolution
Mottis Dogwear is not obliged and does not currently agree to participate in dispute resolution proceedings before a consumer arbitration board, unless a statutory obligation applies in an individual case.
The European Online Dispute Resolution (ODR) platform is no longer available and is therefore not linked here.
18. Applicable Law
German law applies, subject to mandatory consumer protection provisions applicable in the country in which the consumer has their habitual residence.
For consumers, the choice of German law does not deprive them of the protection provided by mandatory provisions of the law that would otherwise apply to their contract.
19. Severability
If any provision of these General Terms and Conditions is or becomes invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.
Mandatory statutory provisions shall apply instead of any invalid or unenforceable provision.
